Stuart Secures Conditional Discharge in Breach of Planning Enforcement Case
Stuart represented two clients who had pleaded guilty to breaches of an enforcement notice.
He argued that although, they had technically been served with the notice, they in fact did not know about it and had not benefitted in any way from the breach.
It was crucial for the clients that they avoided a criminal conviction and this was achieved. Because there was shown to be an absence of benefit, Proceeds of Crime proceedings were discontinued in respect of these two clients.
